Which part of payment is alimony?

Family support consolidates kid support and spousal help into one installment. The court arrange does not determine the amount of the installment is for tyke support and what amount is assigned for spousal help. A court won't issue separate requests for tyke support and spousal help if a family support judgment is entered. Family support is regularly granted where the gatherings are in shared understanding, yet in a few expresses, a court can enter a family support judgment even without the gatherings' assention.

Does the
divorce or separation instrument fix (in terms of an amount of money or a part of the payment) as a sum which is payable for the support of children of the payor spouse.
? If not, it's alimony. provided it meets all the other tests in section 71.

Is there any stipulation that the amount changes once the kid reaches a certain age?

When used correctly and in the rare cases where an attorney has properly set up family support, it can be a very useful tool. However, the vast majority of documents are NOT drawn up correctly and would not pass muster with the IRS. It is best used when support is a large amount; the payor makes a large amount of money and the payee does not. It order for it to be deductible for the payor, there MUST NOT be language that the payment ends when a child reaches a certain age. It cannot be disguised as child support. There are other rules as well which must be followed.
