Client began suffering seizures in 2017 and now is in a skilled nursing facility. She had a durable power of attorney with the County Clerk. Now her POA is handling her finances. Although we have found a lot of her paperwork for 2017, her Forms 1099 are not available. Can her POA sign a Form 2848 to allow me to access her information for 2017 with an attached copy of the filed paperwork?

See procedures documented in IRS publications for perfecting a non-IRS power of attorney. The answer is more complicated than just "yes". Or, search the yellow box, it's been mentioned several times in this forum in the past.

If the client still has he wits about her, why not get her to sign the 2848 and make this a non-issue. Her address is c/o the POA
