Sale of S Corp Stock

I have a taxpayer who owns 100% of his S corporation stock. Corporation has always been an S. If the sole shareholder sells 5% of his shares to his adult child at FMV, does the seller get capital gain treatment? I have researched related party rules, but cannot find anything that would deny capital gain treatment, but still uneasy about it. Thanks as always!
