Non resident withholding paid on behalf of a resident

A client of mine invested in a real estate partnership a while back. The client lives in CA and the partnership sent in non-resident withholding payment to CA on the clients behalf. Is that correct? Should they have sent that on the clients behalf even though they live in CA?

The reason I am asking is because the previous tax preparer did not see the withholding and did not claim it. Now the statue of limitations has passed to claim it and it is not a small amount. Any suggestions?
