Late 1045 filing due to mistake on originally prepared 1045

Hi Everyone,

We filed a 1045 for a client in December of 2020. In January, it was returned to the taxpayer in January of 2021 and asked that we correct an error that was made (we inadvertently removed charitable contributions which are not to be refigured). Based on the NOL we had and charitable contributions involved (NOL was $5M+, charity was 10K), it was a very minor error. We corrected the error and resubmitted the return in February of 2021, obviously now outside of the normal filing window for 1045's. We included a letter explaining the timing in the hopes that the 1045 would still be processed, but were just informed this week they want full amended returns.

We've been in touch with an agent at the IRS over this case and I would like to be able to point to something that bolsters our position that the 1045 should be processed given that it was originally filed timely and the error involved is small. Any ideas of what I can point to?
