NRA need to file 1040 nr to get withholding back

A nonresident alien lives overseas for the full year of 2022 forgot to update w8Ben form and the brokerage firm withheld tax for stock sales, dividend and interest.
I think I can file 1040nr for him to claim back the withholding. stock capital gain is nontaxable by US.
How about interest and dividend income? Is it nontaxable also?
I read the US China treaty (he is a resident of China) and it says dividend is taxed at a rate of no more than 10% by US.
But what is the exact tax rate on dividend in this case?
