HOH and form 8332

Client is non-custodial parent Ex-wife signed release 8332 which will be filed as an electronic attachment to the return of the ex-husband. The 16 year-old daughter did live with mom for more than half the year. The only reason the ex-husband can't claim HOH is because his daughter didn't live with him for more than half the year. Just want to make sure this is correct. I haven't done one of those in a very long time.

Yes, they are not eligible for HOH unless they have a qualifying child live with them for 183 nights or more during the year.

I'm actually dealing with this as well for several clients and have struggled to get a clear answer on how to do the input.

What are you putting for your input? I've had to override in drake that they are eligible for the CTC because if you mark them less than 6 months then it doesn't give them the child tax credit. I know that you have to attached the 8332 to the efile and send a paper copy of the 8453 along with the 8332. Haven't found any consensus on the actual input though...

Thanks. I don't use Drake. My software Ultratax has an option for "child of divorced parents" which seems to do the trick. But I think if you put in child lived with parent 12 months, it only affects the child tax credit.

Do you have to mail the 8453 and the 8332 as well?

Yes, the 8453 instructions says to mail the 8453 with the 8332 form attached within 3 days of the return being accepted.
