Nonresident sold us real property, no w8ben provided to buye

A nonresident alien sold his us real property recently but did not realize he need to let the buyer know he is nonresident and withholding needs to be done by buyer. So, buyer did not withhold tax for the deal. How to fix this?

Why didn’t the attorney for the closing ask the question, that certification is standard with most closings?

The buyer is solely responsible. It is not your client's problem. The client will nonetheless file a 1040-NR for 2023.

My mistake, the buyer did withhold tax

Did your client file Form 8288-B before closing? Was this discussed with the client before closing?
