Financial statements prepared solely for submission to taxing authorities are not subject to AR-C 70.

My issue is does solely for submission to taxing authorities include giving the numbers in an email to the client so that they can give to their 401k plan that prepares the 5500 for the 401k plan that owns 97% of the business?

I think it does.

Is there a particular reason you are trying to bypass the immense flexibility afforded by AR-C 70? Not a CPA? If no valid reason, I would just do an AR-C 70 Engagement, which is how I handle all of my clients. No engagement, no financials.
